This Refund and Return Policy (hereinafter referred to as the “Policy”) outlines the terms and conditions under which refunds, returns, and replacements may be provided by SSS Wattch is Wealth Private Limited (hereinafter referred to as the “Company”, “we”, “our” or “us”) in connection with the purchase of products or availing of services through our platform. This Policy applies to all Customers (“Client”, “User”, or “Buyer”) who engage with the Company for watch-related transactions, including purchases, upgrades, restorations, and service orders.

1. General Policy Statement

1.1 The Company operates on a strict “no return, no refund” policy unless expressly agreed to in writing at the time of purchase or engagement of service.

1.2 Refunds and returns, where permitted, shall be subject to inspection, documentation, and verification by the Company and may be granted at the sole discretion of the Company.

2. Refund Eligibility for Watch Purchases

2.1 All sales of watches through the Company’s trading platform are deemed final upon completion of payment, unless otherwise provided in a written agreement.

2.2 Refunds shall only be considered under the following limited circumstances:

(a) The product delivered is materially different from the one described or ordered;

(b) The watch received is non-functional upon delivery, and such defect is verified by our Technical Team;

(c) The watch is received in a damaged condition attributable to transit issues, subject to the availability of unboxing video proof.

2.3 The Client must notify the Company within seventy-two (72) hours of delivery, along with clear photographs and video evidence of the discrepancy or damage.

2.4 Any refund request made beyond seventy-two (72) hours of delivery shall be deemed invalid and non-actionable.

3. Refunds for Upgradation or Servicing Orders

3.1 Once an upgradation or servicing request is approved and the Client has remitted payment, no refund shall be issued unless:

(a) The service is cancelled by the Company due to infeasibility or lack of parts;

(b) There is unreasonable delay (beyond 60 days from estimated delivery), not caused by force majeure or client-side delay;

(c) The Company determines that the work cannot be carried out as initially agreed.

3.2 If eligible, the refund shall be processed after deduction of applicable administrative charges and incurred logistics or diagnostic costs.

4. Refund Process and Timelines

4.1 Upon approval of a refund request, the refund shall be credited to the original payment method used by the Client, or to a nominated bank account, within a period of seven (7) to ten (10) working days.

4.2 The Client must ensure the accuracy of their bank details. The Company shall not be liable for delay or loss arising from the incorrect furnishing of account information.

5. Non-Refundable Items and Services

5.1 The following are strictly non-refundable:

(a) Watches customised, upgraded, or altered as per Client request;

(b) Diagnostic charges, shipping charges, taxes, or handling fees;

(c) Restoration and service fees for completed work;

(d) Any transaction arising from a pricing negotiation accepted and executed by the Client.

6. Replacement and Exchange Policy

6.1 The Company does not guarantee replacements or exchanges unless explicitly committed in writing.

6.2 In rare cases where a replacement is agreed, the Client shall return the watch in original condition with all accessories, documentation, and original packaging.

7. Fraud Prevention and Misuse Safeguard

7.1 The Company reserves the right to withhold or deny a refund if it suspects, at its sole discretion, any instance of fraud, deception, or misuse of the platform by the Client.
7.2 In such cases, the matter may be escalated to the appropriate law enforcement authorities, and the Client’s account or access to services may be suspended or terminated without notice.

8. Proof of Return and Condition of Returned Goods

8.1 In the event that the Company authorises a return or replacement, the Client shall ensure that the returned watch is accompanied by valid proof of return shipment and that the watch is in its original condition.

8.2 Any damage, tampering, or wear and tear caused post-delivery shall render the product ineligible for refund or replacement.

8.3 The Company reserves the right to inspect and determine the condition of the returned item before processing any refund.

9. No Refund on Luxury Re-Sale Price Fluctuations

9.1 The Client acknowledges that the price of pre-owned luxury watches may fluctuate due to market forces, brand perception, and consumer trends.

9.2 The Company shall not entertain any refund, return, or renegotiation on the ground that the resale value of a product has increased or decreased post-sale.

10. Binding Nature of Refund Decisions

10.1 All refund-related decisions taken by the Company, including eligibility, amount, and method of refund, shall be final, binding, and not open to appeal or negotiation.
10.2 The Client explicitly waives the right to initiate chargeback proceedings through their bank or payment service provider in the absence of written consent from the Company.

11. Limitation on Multiple Requests:

11.1 Repeated or excessive refund requests by the same Client may, at the sole discretion of the Company, result in refusal of further service, blacklisting of the Client, or legal recourse.

12. Force Majeure and Liability Disclaimer:

12.1 No refunds or returns shall be entertained for delays or failures arising due to force majeure events, including, but not limited to, natural disasters, pandemics, strikes, courier disruptions, or acts of government.

12.2 The Company’s liability shall be limited to the refund amount (if approved) and shall not extend to consequential or indirect losses.

13. Governing Law and Dispute Resolution

13.1 This Policy shall be governed by and construed in accordance with the laws of India.

13.2 Any disputes arising under or in connection with this Policy shall be subject to the exclusive jurisdiction of the courts located at Delhi.
